The complaint against His Divine Holiness, Paramahamsa Nithyananda does not contain the word ‘rape’ or the name of any victim. Why was Paramahamsa Nithyananda charged for rape (section 376) without even a victim?
On 2 March 2010, a morphed video of Paramahamsa Nithyananda and a Tamil Actress bombarded the televisions of Indians nationwide. The media frenzy that proceeded lead to the merciless character assassination and persecution of Paramahamsa Nithyananda.
Following the release of the morphed video, a false complaint was given to the CID in Chennai by the main conspirator in the plot against Paramahamsa Nithyananda, Lenin Karuppan. In his complaint, he makes several unsubstantiated claims, alleging that Paramahamsa Nithyananda has cheated His devotees. Based on this complaint, Paramahamsa Nithyananda was charged with rape (section 376). However, in the entire complaint, there is no mention of the word rape, any victim of rape, any incident of rape, or any date of rape.
The only “evidence” that Lenin Karuppan cites in his complaint is the morphed video with Tamil actress, Ranjitha, who has categorically denied the validity of the video. In fact, it was later revealed that Lenin Karuppan and the other conspirators harassed, tortured, blackmailed, and extorted Ms. Ranjitha in attempts to force her to file a fake complaint against her own Guru. Despite being under duress, she refused to file a false complaint against the being who she worshipped as God. As a result, Lenin Karuppan filed the complaint himself against Paramahamsa Nithyananda and many senior disciples as a third party witness and an FIR was registered charging Him of rape. For the first time in Indian history, a rape charge was filed against someone without a single piece of evidence, witness, or even victim.
This gross abuse of power by the CID reveals a larger planned conspiracy against Paramahamsa Nithyananda with many anti-Hindu elements including the police playing a role.

“Around 7 months back, when Sri Vimalananda Swami of the ashram went to serve Nithyananda, he revealed with pain that Swami indulged in homosexuality with him. Developing depression due to this, he left the ashram. From then on, I developed hatred towards Swami Nithyananda’s activities. Since in Nithyananda’s quarters, resting room, the resting room inside the meditation hall, only female disciples serve him, I got the suspicion that he might be misbehaving with them also.
In November 2009, Swami Nithyananda’s secretary Ma Nithyananda Gopika told me of being tortured by Swami Nithyananda physically and mentally. That was a big shock to me. Through his secretaries Nithyananda Gopika, Sri Nithyananda Sadananda, Sri Nithya Pranananda, Sri Nithya Sachitananda, Sri Nithya Bhaktananda and important disciples Sri Nithya Atmananda, Sri Nithya Gnanananda, Sri Nithya Atmaprabhananda, PRO Sri Nithya Sevananda, and his brother Sri Nithyeshwarananda, he would get the male and female disciples whom he liked into his room and tell them to do service. I came to know that at such times, he would tell the male and female disciples, for you to get enlightened and attain my state, you have to fulfill my wish, and cheat them and have physical relationship with them.”

Because I may be endangered by Swami Nithyananda or his supporters, I have come to Chennai and given you this report. Having filmed Swami Nithyananda’s bad activity, I am handing over along with this report, to you, its video CD containing the scenes. I ask that appropriate action be taken on Sri Paramahamsa Nithyananda and those who were his support and who did these wrong deeds, and protection be given to my life. My native place is Vepampoondi village in Salem district, Attur taluk. I have studied till BBA. Around 1996, I came to Chennai, and in Adyar, I did the pesticide spraying business. Starting from approximately 2004, I went to Sri Paramahamsa Nithyananda Swami’s programs, listened to his discourses, and developed tremendous devotion towards him and spirituality, and in August 2006, I went to the above mentioned address – Nithyananda Dhyanapeetam – in Bengaluru and stayed there itself. Swami Nithyananda changed my name Lenin to Sri Nithya Dharmananda. In the ashram, I was attending to release of books, CDs, and DVDs. Approximately 250 people between the ages of 18 to around 60, men and women, stay in the ashram as disciples and do service. For everyone, food and accommodation are provided in the ashram. This ashram is on an expanse of 40 acres. In that, Swami Nithyananda’s living area is on an expanse of around 1 acre. Swami Nithyananda will be in the ashram for around 6 months in a year. In the remaining time, he will go to the programs happening on behalf of the branches in India and world over. Thousands of devotees and public come to the meditation programs and spiritual discourses conducted by Swami Nithyananda. I have gone with him to many programs in the past 4 years. Around 300 devotees come every day to the ashram. In his discourses, Swami Nithyananda would say that his disciples should practice brahmacharya to attain enlightenment, and that not to talk to girls, and that he is an avatara purusha of Krishna, and that he is an avatar of Shiva and Parvati. In the same way, he would tell the devotees who come to the ashram regarding meditation and getting enlightenment. Several VIPs from society visit the ashram. In the ashram, there are rules that no one should watch the television, no one should read the newspaper, and no one should hold an independent cell phone. In the ashram, 1-day, 2-day, 4-day, 1-week, 21-days, 3-month duration meditation programs happen. For this, from 1000 rupees to 4 lac rupees, per person, they will collect money. Further, Swami Nithyananda will hug and bless both men and women who come to the meditation programs. In the ashram, approximately 100 female disciples are there for Swami Nithyananda. Further, he will tell the women that he is a Krishna avatar and he would hug the beautiful women and tell them that they are gopikas. Swami Nithyananda will talk very fluently in Tamil and English. According to that, in December 2009, through one of Nithyananda’s secretaries, we placed a camera in his bedroom. After two days, that secretary gave me a memory card and told that Nithyananda Swami’s leelas are recorded in it. I saw that scenes of Swami Nithyananda and actress Ranjita enjoying in the bed were recorded in that. Actress Ranjita visited the ashram over the past one year. Whenever she would come to the ashram, she would stay in the room near Swami Nithyananda’s bungalow. Last year, when Nithyananda Swami went to America also, actress Ranjita went to all the places he went to. I was expecting the moment to show to the outer world the scenes of Swami Nithyananda enjoying with actress Ranjita. At this time, I went with Swami Nithyananda to Coimbatore for the Bhagavad Gita satsang that happened on 18.02.2010 and 19.02.2010. In the afternoon of 19.02.2010, we started in the tempo traveler vehicle from Coimbatore to Salem. Along with me, 15 disciples and in 5 cars, Nithyananda Swami and his disciples came. Besides seeing me with a suspicious eye, they kept asking me unnecessary questions. At that time itself, I got the fear if someone might have told about taking the film. That day evening, we came to a place called Seeragappaadi, Salem at 4 pm. There, a new ashram inaugural function was going to take place. There, a lot of devotees had come. There, his secretary Sri Nithya Pranananda, took me and went saying to come to Sri Paramahamsa Nithyananda’s caravan van. Swami Nithyananda and his disciples who were in the van threatened me asking, did you take any film in the ashram? I told, I did not take any film, don’t unnecessarily suspect me. For that, Swami Nithyananda threatened, if you don’t tell the truth, we will strangle your neck and murder you in the van itself. I got afraid and told, check my belongings. He left me with the disciples and went away for the program. Fearing that if I am with them anymore, they will kill me, saying that I want to go to the bathroom, I went into the crowd and escaped.

In this ashram, in December 2008, a person from Canada aged around 40, who came and stayed for the Inner Healing program, fell down from upstairs and died mysteriously. An appropriate inquiry was not conducted regarding this death. In the same way, due to his torture, a young sannyasini and an 18-year old male disciple indulged in an attempt to suicide in the year 2008. In the same way, in the year 2009, an ashramite by name Azhagan, ate sleeping tablets and attempted suicide. For all these people, they gave treatment at the B.G.S hospital which is in Hengery, 15 kilometers away from the ashram. Further, Swami Nithyananda has beaten those in the ashram with a stick and injured them. Knowing Swami Nithyananda’s strength of money, people and wealth, and fearing that their lives will be in danger, no one told these things outside. Further, Swami Nithyananda brainwashed us around last three years by saying several times that even police can come to the ashram, even if any wrong news comes about me in the television or newspapers, you don’t need to believe it; I am an incarnation of God.

Paramahamsa Nithyananda Endures Illegal Arrest and Third Degree Torture in the Hands of Police
Due to a wave of sensationalism in the form of rumors and false allegations sweeping the media and resulting in pressure on the judiciary to take immediate action, Paramahamsa Nithyananda was illegally arrested based on fabricated rape charges. On 21st April 2010, in Himachal Pradesh in India, police illegally detained Him and brought Him back to Bengaluru.
In any case of rape, either the victim or the State files charges against the defendant. However, it is completely unheard of for a person to be arrested for rape based on a complaint filed by an unrelated third party. Furthermore, till the time of Paramahamsa Nithyananda’s arrest, not a single piece of valid evidence was brought to light nor a single victim had given a statement against Him. No due process was given to Him. Based on anti-Hindu propaganda, He was simply arrested.
His Divine Holiness Paramahamsa Nithyananda was illegally detained in prison for 53 days.
Years later the Karnataka High Court issues written ruling that the arrest of Paramahamsa Nithyananda was not authorized on any grounds!
During His illegal imprisonment, questions started to arise about the validity of such an arrest including from the courts. In a desperate attempt to justify the illegal arrest, the CID began hunting for victims to depose against Paramahamsa Nithyananda in mainstream and social media. Despite all their efforts, they were not able to find a single viable victim in the 53 days they kept Him illegally imprisoned.

“The CID Superintendent of Police Yogappa, in a release here, said all those affected and the victims of Nityananda were free to contact him and depose. He said the travel expenses of those willing to depose before him and provide information would be met by the department and their identities kept in utmost secrecy.”
He also states that: “Despite our best efforts, not a single “victim” has come to us stating that the Paramaham sa Nithyananda had unnatural sex with him/her or raped her. We got some emails from persons living abroad but they have not provided any evidence.”
Inhuman torture
Not only was He illegally arrested, but also illegally tortured. Third degree torture was used in an attempt to get a false confession from His Divine Holiness.
He was exposed to the dust of tiles when there was 8 days of continuous cutting tiles in judicial custody. He was forced to inhale the dust, which is known to cause cancer leading to death.
While this was an unsuccessful attempt, it was a gross violation of His fundamental human rights. Any incident such as this would have provoked nationwide outrage – and yet this information was not given any media attention, nor publicity.
During those 53 days in prison, He was denied food and water.
Basic legal rights of someone in custody were denied to Him. Pictures and footage of His Divine Holiness in custody were leaked to the media. When inquired, the police instantly framed their CCTV electrician for theft of footage and completely allowed the media to loop the footage on their channels! It was a clear plan to ruin the reputation and hurt the devotees of His Divine Holiness Paramahamsa Nithyananda. When the court was petitioned to provide this footage in order to prove third-degree illegal torture, the State CID lied to the court that the CCTV footage was stolen!

Above all, such a blatant disrobing of someone’s privacy, fundamental human rights has never been done to any Indian citizen the way it has been done to His Divine Holiness Paramahamsa Nithyananda.

Swami Nithyananda who is embroiled in a sex scandal would be presented today in Solan in Himachal Pradesh. Nithyananda and his three aides were arrested yesterday in Himachal Pradesh. Nithyananda made the headlines after being seen in an obscene CD with a South Indian Actress. Finally, police have ended the underground stay of Nithyananda. Nithyananda who was seen in an obscene CD with a South Indian actress was finally arrested by a team formed by Himachal police and Karnataka CID. The police apprehended 3 of his aides Nithya Bhaktananda, Gopal Sheelum Reddy and Shailesh Reddy along with Nithyananda from Arki in Solan. The police team also seized Nithyananda’s computer hard disk and many identifying documents. Bhandari, SDG, CID, Himachal Pradesh: A lot of belongings and items have been captured. There were two people.- Arun Raj and Arpit Singhal, who had made a flat available to them. They were staying there. ”There is a charge of offending religious sentiments against Nithyananda, apart from the charge of fraud under section 420. There are many cases registered against him in foreign countries. There are also charges of land grabbing against Nithyananda. Apart from this, Nithyananda’s driver Lenin Karuppan who made the CD has also registered a complaint of life threat against Nithyananda. Although a few days back Nithyananda had sent a tape to a Tv Channel saying that he was resigning from all posts in Dhyanapeetm and staying in an unknown location (agyat vas)for some time. Swamiji:”decided to live a life of spiritual seclusion for some indefinite time to which the Acharyas have agreed in principle. In view of this and to enable the Dhyanapeetam to function with such amended agenda as may be necessary I am resigning as the head of the Dhyanapeetam and from all the trusts associated with it.”Since 27th march Nithyananda had been in hiding in Arki Today Nithyananda will be presented in the court. After that the Karnataka CID team will take him to Bengaluru for further proceedings , with Pramod Raghvan, Sanjeev Sharma for Zee News, Solan.

Controversial godman has been granted a conditional bail and he is likely to be released now on Monday. Nithyananda who is facing the charges of rape and unnatural sex is in custody since his arrest in April, the scandal around him broke out when the local channel started airing a video said to be of Nithyananda was found to be with a tamil actess. Nithyananda’s main ashram is located in Bidadi in Bangalore. Ashram authorities claims he has lakhs of followers.

Well, we know that he was there is Himachal Pradesh perhaps for some time. The police had got a tip-off and the Bangalore CID which is investigating the case arrested Nithyananda.
We are not really sure if the arrest happened ashram or a hotel but however, the swami was definitely in hiding.
Now the trouble really starts for the Swami now because there are many cases pending against him in Tamil Nadu and in Karnataka.
There is even a case which is registered against him in California by a former disciple.
He is been charged under many sections of the Indian Penal code including cheating, murder, a threat to life, conspiracy and hurting religious sentiments.
In fact, just two weeks ago the Karnataka High court had even criticized the Bangalore police for not taking enough action in the case, which is perhaps why under pressure the Bangalore police have now acted and arrested Swami Nithyananda.

Video footage of CID’s interrogation gets leaked!
“Video footage of CID interrogation ‘stolen’ to hide the attempt to kill His Divine Holiness Paramahamsa Nithyananda.
The upholder of law and order, the law enforcing agencies, the Police. We would expect them to catch thieves and villains, but surprisingly CID claimed someone stole the CCTV footage of CID interrogation of Paramahamsa Nithyananda.
When His Divine Holiness asked through the Court to summon the interrogation tapes of his interrogation portions of which were illegally and unabashedly splashed on television as entertainment, the police came up with not being able to produce them as they were stolen from their very office! These interrogation tapes would have revealed the third degree torture, including the brazen attempt to kill by cutting tiles throughout day and night near his cell so that he is forced to inhale the fine stone dust which would result in lung cancer in the long run.

Times now exclusively shows the interrogation of nithyananda involved in sex scandal. His confessions are in the video. His first confessions is , what CID’S ask whether it is HIM in the video. Nithyananda answers that, he knows that the woman in the video is an actress and i don’t recognise anyone else. I was in a state of trance. The second question was, why the idols are made here and sold with American invoices ? In his reply he says that the money directly goes to the trust and there is no money laundering. The CID asks where the 39 crores in the trust come from? For this swami replies mostly comes from donations. Swami Nithyananda was arrested on 21 april 2010.on the basis of an FIR filed by a criminal lenin karuppan who himself has rape charges against him. And the complain have no mention of the word rape. The arrest of swami nithyananda was the victim of the entire hindu forces. The arrest was the cheap exploitation of the frenzy created by the media based on the video SUN TV had morphed.It was admitted publicly by by COO of SUN TV.

They stop play out , if given money. That news editor raja and his team are the one’s who do this. What they do in the team is , they keep a team of members all over Tamil nadu and they ask to go around and cover a factory. They show that the factory has industrial waste coming out and people are suffering , they take a video of a old lady coughing . They send a person with this video and negotiate and demand money.
The CID had a full plan of making a shockingly cheap mockery of justice.Swami Nithyananda was kept in police custody from 21 April 2010 to 30 April 2010, grilled and tortured with heavy lights.He was made to sleep on a cold wet floor. Not allowed to sleep by continuous sound of breaking tiles and much more. The court documents, shockingly shows the contents of work order for the interrogation room with 17 cops, the light to be really harsh and make the room real drab. After 8 days of third degree interrogation CID could not find any crime against swami Nithyananda. In fact, he openly challenged CID , that they do medical test on him, which would prove that he is not even physically capable to have a sexual act. But the CID never did a medical test. Right after 3 rd May 2010, SUN TV repeatedly telecasted the interrogation of Swami Nithyananda . How such a confidential video could be telecasted in the media ? Got a shocking reply that the interrogation tapes were stolen. The upholder of law and order , the law enforcing agencies, we would expect them to protect everything . But surprisingly police claims that someone had stolen the CC TV FOOTAGES of CID interrogation of swamiji from there own office. Udaya TV , one of SUN tv network, which created the morphed video of Swami Nithyananda,telecasted a program regularly showing the interrogation. The CID had claimed that Swamiji was not cooperating with the investigation which by the way was not expected by the law. They got extension of police custody for 8 days and when they asked for the extension the court flatly refused. They said they don’t find any reason as per the CID’S report till date. CID claims that Swami Nithyananda was not cooperative for interrogation. But if one sees the entire interrogation tapes , Swami Nithyananda speaks throughout the video and the police were silent.
The CID, claimed that interrogation tapes were stolen from a high security office. The shocking injustice doesn’t end here. The illegal theft of video tapes,went on trial and brought out shocking facts of crimes committed by CID officers top down.
The CID claimed , I the complainant is working as the superintendent of police in Bengaluru looking after administration of CID. In CID premises ,an interrogation room with lockup is under construction. For that purpose , CID authorities entrusted the work to PWD Department , in turn the PWD called a tender for the same. Said construction was entrusted to Sanjay Marketing ,Jayanagar ,Bangalore.Said Sanjay Marketing Company has entrusted the work of installing Audio , CCTV system in the said interrogation room to MAASTEK Company . Accordingly the said work is in progress. The said company installed the audio and CCTV system in the interrogation room. Lock up room and the control room for the same in separate which is just adjacent to the interrogation room which was under finalising stage.
The said installation of audio and CCTV system room which was under the supervision of PWD engineer Sri . Rajesh and MAASTEK Company proprietor Vijay with one Venkatesh , Suresh, Sagar and Srikanth were the workers and Technicians working under the same.
On 22.04.2010, after 11.45 p.m one accused by name Nithyananda Swamy of Bidaidi PS Cr Sc 141 2010 ws kept in the said lockup and his interrogation was continued in the said interrogation room.
On 03 may 2010,in 10.30 and 11 p.m ,a program called red alert which was displayed by Udaya tv, surprisingly displayed the entire video clipping of the interrogation room of the said accused on 03-05 -2010. The said clipping was even put in youtube in the internet. Both the program was seen and witnessed by the general public. In this way the accused present, illegally in the interrogation , committed the theft of investigative materials and for the wrongful gain shared the clipping to Udaya TV channel and displayed the same in the YOUTUBE program on internet. Subsequently the said video clipping displayed in other channels also.
In this way , i suspect the involvement of the above mentioned proprietor MAASTEK Sri.Vijay and his workers Venkatesh , Suresh ,Sagar and Srikanth were conspired together and have dishonestly and fraudulently without the permission of CID Officials accessed the computer system which is connected to CCTV cameras and downloaded the said video clippings and shared the same with Udaya TV,Youtube and other agencies. Then they also committed theft of the digital property of CID nd cause obstruction to the investigation of Bidadi PS CR.No.141 10.Hence it is requested to take appropriate legal action and the guilty to be punished.
The accused made shocking Revelation:
Suresh : Sir, i was working as consultant for M/s.MAASTEK. On 22 nd April Mr.Vijay called me to his office and told me to install CCTV system in COD office , i along with Mr.Venkatesh [ Manager ] and 2 technicians by name Srikanth and Sagar went to COD office to install CCTV system. We completed installation of CCTV system on 24 the April 2010 by evening, in the course of time as there was a problem in video and audio clarity. I called Vijay, he told me to copy the footage and send through Venkatesh in pen drive. I did according to his instructions.
On 4 th morning, Vijay called me to his office and told me that Nithyananda interrogation clips has been leaked out please go and clarify. I along with Venkatesh went to COD office , there we met Mr. Charan Reddy and other inspectors. Mr. Charan Reddy told that those who have taken the clippings please clarify. I will take you to the DG, he will leave you by taking one apology letter in the same day afternoon Mr. Vijay came to COD office and after discussing with his staff he called me and said , if case is registered in Maastek’s name, the amount which has to be given of about 8 to 10 lakhs, CCTV, system and reporting that the Equipment will be seized and until and unless the case gets solved. He told me that you go and approve the guilt , rest i will manage.
On 5 th morning along with Venkatesh, Srikanth and Sagar, i went to COD office they made us to sit till 5 p.m , i got frightened and asked my lawyer to come to COD office and after lawyer came and spoke to Mr. Bheemaiah admin. in charge he told that if there is need of him we will inform, and afterwards i left COD office.
On morning, they once again called me and they told me to wait outside till 3 pm and SP Mr. Chandrasekhar, Mr. Marishetty, Mr. Vinayak and others called me to SP Mr. Chandrasekahar’s cabin and started interrogating me. And before this, Vijay , SP Mr.Chandrasekhar, Mr. Marishetty spoke to me and told that you approve the mistake, because Maastek company name comes in FIR, the amount which has to be given will be held and we will just put one small case and close the matter because you are no way related to Maastek company. In the meantime, Vijay ordered his brother by name Prabodh to bring 2 lakhs cash which i do not know for what purpose ,they took my mobile and there was no communication to communicate either with my family or lawyer.
Around 9pm, SP Mr.Chandrasekhar called 2 constables and one inspector spoke to them and then they took me to lodge by name RAJA GALAXY around 11:30 pm, they told me to enter the register in my own writing, they didn’t provide me even food, they took me inside, removed my clothes, tied my mouth and legs and hot me and told me to agree, otherwise, we know what to do and they tortured me whole night. They instructed me to tell, that I have given the pen drive to Sinchana Media. I was unable to bear the torture and around 1am, I agreed to say according to their instructions. Next morning on 7th May 2010 on 8:30 am they took me directly to COD office. Sir you can actually ask Mr.Shafi and take their calls for that particular time and you would know the truth and even they threatened me that if you tell anybody, that you were in lodge you will face dire consequences.
On 7th May 2010 morning, I saw Mr.Vijay and SP Mr.Chandrasekhar sitting together and discussing the issue, I was frightened and went and asked what is the issue. They said nothing serious you just go and meet Vinayak, he will look after everything.
I went and met Mr.Vinayak investigating officer who is in charge of this case and made me to sit till afternoon, they registered FIR on my name and took me to Sinchana Media office and told me that we will show you the system there, you just go and open where the video has been copied which i do not know. From there around 6:30pm along with Mr.Vinayak, Mr.Marishetty and one constable they took me to Magistrate house they told me that if you tell that they took to lodge and hit you, we will register another case and you will be in serious trouble, as per their instructions when Magistrate asked me I replied I said they treated me very well and then they took me to judicial custody and arrested me.
I was in Judicial custody for one week and I am out of Jail now on bail.Even after case has been registered and I am on bail, they are harassing me and torturing me calling me all the time and saying that if you do not agree, another case will be registered in your name. They are harassing me and trying to take signature on statements as per their wish forcibly. DIG Mrs. Malini Krishnamoorthy and Mr.Kishore Chandra are abusing me and scaring me during interrogation.
They are sending constables to my house and simply torturing my parents, when i am not there, I am mentally depressed if the same thing continues, I am thinking of commiting suicide due to the agony which my parents are facing due to COD police harassments. In such case only COD police has to be blamed and take responsibility of any extreme situation.
My wellwishers and friends advised me to go and meet SHRC Justice S.R.Nayak.
I would like to come out of this mental and physical torture which I have been facing from past one month, I hope that the culprits would be punished and justice would be give to me on the above mentioned subject.
I have complete faith in law and that you would provide justice to me.

The Court order says
the CID claims that they confiscated the tapes from the accused in their company. But the statements in the court say, it is not true to suggest that on the above date when I had been to the COD office that the accused were present. It is not true to suggest that later the COD police have seized the hard disc shown to me now from the possession of accused through ex.P.1 mahazar in my presence and later I signed Ex.P.I. It is not true to suggest that I know the accused very well. It is not true to suggest that to help the accused I am giving false evidence.

I have no any technical knowledge about the computers. COD police did not seize any hard disc in my presence.
They presented as if Paramahamsa Nithyananda was silent most of the time and spoke only in monosyllable.
But if one sees the footage it can be seen that only Paramahamsa Nithyananda is speaking throughout the video and the police is silent!
An application to summon for Paramahamsa Nithyananda’s interrogation tapes was filed to prove the third-degree interrogation as well as the character assassination by releasing the silent (voice muted) videos of him in the interrogation room being questioned by the police. This was allegedly given to the media by the CID but when questioned the CID police claimed that the tapes were stolen (from admittedly the most secure place in the State!).
Below is a highlighted portion of the Statement of Objection filed by CID Bangalore. The police claimed that the application filed by the accused is not admissible because there is no evidence to verify the statement against the police with regards to them releasing the interrogation video to the public. They further claim that they did not have access to the Audio or Video recordings from the CCTV footage of accused 1 when he was in CID custody. High Court States Case Lacks Evidence

Here are the 1st visuals of the tainted Swami Nithyananda being released from the Bangalore jail. Swami Nithyananda was granted bail on Friday and was arrested on charges of rape and as well as molestation.Aslesha is with us on the phone lines.
Aslesha what are the conditions of the release and secondly was it that the Bangalore Police was not able to build you know a good enough strong case around him that he’s finally managed to get bail?
Well, it’s absolutely right. Just a couple of minutes ago, we had Swami Nithyananda being released from the Ramanagaram jail. That’s where he was for the last 40 odd days.
Of course. During that period he was also in CID’s custody. So a total of 50 days that Nithyananda had spent in custody. Of course. Yesterday, the Karnataka high court granted bail for the tainted god man. What the Karnataka high court did say was that the prosecution was not able to gather enough evidence against the god man and that is why they were granting the bail. Now of course, this bail was subject to a couple of conditions, one of which was a personal bond for 1 lakh rupees and 2 sureties.
Of course Swami Nithyananda also has to surrender his passport before the court and he does not have any permission to leave the country without the permission of the court and what is most significant is really that Swami Nithyananda has been forbidden from undertaking any sort of public sermons and public classes during this bail period and if he were to undertake any of these sermons then his bail stands cancelled is what the Karnataka high court has said. Now of course Swami Nithyananda is facing charges under several sections of the IPC. That is if I can just recap for you 295-A of the IPC which suggests hurting religious sentiments. There is 506 for criminal intimidation, 420 for cheating, 376 for rape, 377 for unnatural offences and 120-B for conspiracy. So really his bail plea having been granted on ground of insufficient evidence having been collected by the prosecution.

What to be reported about the above subject is that on 18-3-2010 in Bidadi Police Station case based on 112/2010 Sec 295(A), 420, 376,377, 506(2) and 120(B) IPC was received from Chennai City Crimes Division and registered the case as Bidadi PS Case no.141/2010 sec 295, 420, 376,377,506(1) and 120(B) IPC. THE CID division has received Head Office order no. Crimes/23/CR RA No./2010 dt/19-3-2010 for further investigation of the case. At the time of the investigation, request has been submitted at the time of investigation to the Chief Judicial Magistrate of Ramanagar and twice search warrants had been obtained, and all the buildings and the living room of the accused Paramahamsa Nithyananda in Nithyananda Dhyanapeeta, Kallugopahalli in Bidadi were searched and seized through inquest 23 computer harddisks and 2 registration books, and entered in the List of Articles and teh court order has been obtained. They have been sent to the Central Forensic Laboratory, Department of Disputed Documents, Hyderabad for expert opinion. The opinion of experts is yet to come.
On 21-4-2-1-, in Malvich of Vikrampur City of Solan Dt. In Himachal Pradesh, Sri.M.S.Hussein Sub-Inspector of CID Department and also Sri.C.B.Hosakeri, arrested the accused-1 Nithyananda Swami and Nithya Bhaktananda, alias Gopal Sheelum Reddy and at the time 10 mobile phones, 9 sim cards, 3 laptops and 1 pen drive have also been seized and had been sent to Central Forensic Laboratory, Hyderabad, and the report from the experts has arrived. In traditional programmes of Brahmacharya and Vanaprastha, the devotees /volunteers are required to give their consent and acceptance to stimulating activities relating to sexual activities and participate. This has been highly controversial and can be considered as evidence for the crime.
On 24-4-2010, the complainant of the case, Sri Nithya Dharmananda, alias Lenin, had been subjected to interrogation at the CID office. The Non-Disclosure Agreement (of 10 pages) which was produced by Lenin at the time of interrogation has been seized and entered in the list of articles. In the 9th page of the said document, it is observed and agreement has been made wherein without the prior consent from the accused (Nithyananda), the activities about the sexual and other activities of the accused Paramahamsa Nithyananda Swami with the volunteers of the Ashram should not be revealed. To the said document, on behalf of Nithyananda Dhyanapeetam Trust, the trustee Smt.Ma Sadananda alias Jamuna wife of Sadananda had signed , it is revealed. An original CD videographed by the said complainant and 2 vie chips pertaining to the accused Paramahamsa Nithyananda and one of the main witness of the case Smt.Ranjitha Menon behaving indecently have been sent to the Forensic Laboratory in New Delhi and the experts opinion has been obtained. The experts have examined the two memory cards and informed that they are genuine CDs and no tampering what so ever had been made and in the two memory cards 58 files had been deleted. They have been retrieved again and the complainant has to be subjected to interrogation and obtain the information.
The main witness of the case Mrs.Ranjitha Menon has told through her lawyers that she would come back to the country and appear for enquiry. Her lawyers have been contacted through telephone.
It is known through some close contacts of another witness of the case Mrs.Ma Nithyananda Gopika that she also will be coming to Karnataka shortly. She would be interrogated when the information is known.
18 year old boy Nithya Vairagyananda is yet to be interrogated about his attempt to suicide by consuming poiso since he could not tolerate the torture given by Nithyananda Swami. His mother Nithya Nirantara is in Malaysia and she has been contacted through some well wishers. It is known that she also would be coming to Tamilnadu shortly she will be enquired.
Some anonymous threatening e-mails have been sent to the complainant of the case Sri Nithya Dharmananda. About this information is being collected through cyber police station.
Because of all these reasons, investigations about the case is under progress. Even though statements have been collected from 48 witnesses available so far no useful witness is available against the accused. Since main witness are in foreign countries, in order to interrogate them still more time is required.

You may have seen Arathi Rao and Lenin Karuppan claiming on TV that His Divine Holiness Paramahamsa Nithyananda’s bail should be rejected as his people are trying to intimidate them. This comes as part of their sinister conspiracy of keeping Paramahamsa Nithyananda in jail by all means and kill Him in the prison by poisoning Him.
What is the truth?
Flashback to July 2011.
The complainant Lenin had gone to Court claiming intimidation of witnesses was being done by Paramahamsa Nithyananda and hence his bail should be dismissed.
Below is an elaborate explanation by the Hon’ble High Court of Karnataka as to why there are “NO REASONS MUCH LESS OVERWHELMING REASONS FOR CANCELLATION OF THE BAIL” because filing of complaints against injustice is the right of any citizen of the country as right to justice is his fundamental right in a democracy. In fact, filing a legal complaint is not only the right but the responsibility of the citizen.
Some highlights of what the Judge said on record
The ground on which the State has sought for cancellation of the bail are that, the respondents through their followers have intimidated and threatened the original complainant by filing several false complaints against him before JMFC at Ramanagar.
The basis for urging these grounds is the fact of filing several complaints by persons who are stated to be disciples of Accused No.1. It is also pertinent to note that in these petitions, the original complainant has not filed affidavit complaining that he is being intimidated or threatened by any of the accused persons or any of his devotees or disciples.
Merely because the complainants in these complaints are stated to be either the devotees or disciples of Accused No.1, it cannot be presumed or inferred that those complaints have been filed at the instance of Accused No.1 with a view to intimidate the person named as accused in those complaints.
If the aggrieved persons, in order to protect their civil rights over property. institutes civil suits, it cannot be said that they have tried to interfere with the investigation or progress of the matter.
Having regard to the facts an circumstances of the case. In this view of the matter, these petitions are dismissed.

It is actually their foolishness that they did (meaning false rape victim and Lenin). Taking someone’(S)advice and based on rumours, they felt they should not be aggressive in Tamilnadu etc…But after that, today, they are completely in my control. They listen to what I say. So using this situation effectively and silently finishing it off it is your intelligence.
This was further substantiated by a video that was telecast by Sun TV wherein (false rape victim) and Kalyan Raman are seen walking together and (false rape victim) claims to Sun TV that she was intimidated by Paramahamsa Nithyananda’s followers.

In 2010, a former disciple of Samiyar Nithyananda has filed a rape complaint against him. Karnataka CID has filed a case regarding this. In this case, a woman from Chennai, Aarathi is named the main witness. The CID has taken statements from Aarthi Rao. Based on her statements and of the investigation by the CID, a case has been filed against Samiyar Nithyananda and he has been ordered by the court to undergo the potency test.
Aarthi Rao has given a report that she is being threatened and followed by some strangers. Aarthi lives in Teynapet with father Sethumadhavan and family. She’s being watched by some unknown men past two days. She has met with the Commissioner of Police directly to give a report regarding this.
Aarthi: I have life threats. There are concerns on the safety and security of my family and myself. Please investigate this matter and give us proper justice is my request. There’s a threat to my life because I’m the main witness in Nithyananda’s case. I have given a complaint regarding this on 1st August. This incident was very suspicious. I felt suspicious that they are tampering with our car, trying to cause physical harm. There’s no one else with enmity towards myself or my family. So if at all any problem or harm comes to my family or myself, it is only by Nithyananda or his disciples. They have not approached me to convince me, but to silence me, they have put many cases against me in many places. I’m fighting for dharma, I don’t want any other girl to get cheated like me, that’s why I’m still fighting. Dharma surely win.

Chargesheet: complaint by alleged child molester!
Paramahamsa Nithyananda revealed the shocking fact that the additional charge sheet was based on a sexual harassment complaint made against him by an individual who himself is facing charges of child molestation! The complainant, Vinay Bharadwaj, a resident of the USA, is currently facing trial in Seattle, USA for multiple counts of child molestation.
In his complaint against Paramahamsa Nithyananda, Bharadwaj had said that the former had ‘brainwashed’ him into a homosexual relationship. Significantly, although Paramahamsa Nithyananda was arrested in April 2010, Bharadwaj came out with his ‘complaint’ only AFTER the child molestation case was filed against him. Using the Paramahamsa Nithyananda case as a clever excuse to escape conviction, Bharadwaj claimed that it was Paramahamsa Nithyananda who had set up the child-victim’s parents against him, because he had complained about Paramahamsa Nithyananda’s homosexual advances. It must be noted here that Bharadwaj is a 36-year-old successful techie and a graduate from IIT from USA’s top-ranked Rice University – hardly an individual who can be ‘brainwashed’ into a homosexual relationship for more than four years!
While taking cognizance of the Skype statement of an alleged child-molester, the chargesheet had conveniently omitted the statements of 15 other witnesses who revealed telling details against Bharadwaj and other conspirators, including medical reports and blood examinations.
“Am I a toy, that anyone can throw me into jail and out of jail as they please?” asked Paramahamsa Nithyananda, reiterating the fact that He had been arrested and illegally imprisoned without even a victim.

Quoting over 60 proofs, these reports have conclusively declared the incriminating video to be fake. The reports also revealed that both the Forensic Science Laboratory (FSL) report submitted by the Karnataka CID as part of the chargesheet were highly untenable as they completely lacked scientific data, and established no basis for even their positive identification of the persons in the video.

In a significant development, the Hon’ble High Court of Karnataka accepted the USA Court ordered medical records of Mrs. Aarthi Rao, the false rape accuser in the His Divine Holiness Paramahamsa Nithyananda case. These medical records show the false rape accuser having multiple STDs (Sexually Transmitted Diseases) from year 2004.
The counsel for Paramahamsa Nithyananda, in the hearing on Crl.P. 4582/2012 for the quashing of the medical test summons issued to Paramahamsa Nithyananda, produced the medical records of Mrs. Aarthi Rao, issued to Paramahamsa Nithyananda by the USA Court from the University of Michigan Hospitals, the custodian of her medical records.
The Counsel pointed out to the Hon’ble High Court that the false rape accuser has been a patient of vaginal herpes since 2004, and has been undertaking continuous treatment for the same since then. The STD vaginal herpes is highly contagious and highly transferable disease. It is very likely to be transmitted to the male partner of such a patient. Even if the saliva of the patient comes in contact with the partner, the disease is transmitted.
So if indeed there had been over 40 instances of sexual abuse by Paramahamsa Nithyananda over 5 years as alleged by Ms.Aarthi Rao, then the disease would have been transmitted to Paramahamsa Nithyananda and he would have been infected with the same.
The Counsel produced the medical records of Paramahamsa Nithyananda which show that he tested negative for any of the STDs, including herpes. In fact, Paramahamsa Nithyananda’s comprehensive medical tests performed in September 2012 have already proved that he DOES NOT HAVE and HAS NEVER HAD any sexually transmitted disease in his life.
In this light, the Counsel argued that the fraud rape accuser ought to have been subjected to the medical exam instead to verify her medical records.
The Hon’ble Court then took on record the medical reports of Mrs. Aarthi Rao and issued an oral direction to the prosecution to find out why these records had not been brought into the case.
The Investigating Officer (IO), DSP CID present in the Court was asked whether he had received these medical records from USA. The IO admitted that he had received the records. The Counsel argued that it seemed that the records however did not see the light of the day as there seemed to be vested interests in the police hiding evidence counter to the prosecution case. The further processing to take the medical records on file is on.
The Court then adjourned the hearing on the quashing of the medical test summons on Paramahamsa Nithyananda, to next week.

FBI Academy infectious disease expert writes rape charge on His Divine Holiness Paramahamsa Nithyananda is false

In yet another corroboration by medical experts, the Federal Bureau of Investigation (FBI) Academy specialist on infectious diseases Dr. McIlroy, has categorically stated in his detailed report (full report below) that the rape incidents alleged by Aarthi Rao against His Divine Holiness Paramahamsa Nithyananda are false and untenable.
He states clearly that Aarthi Rao suffered from multiple Sexually Transmitted Diseases (STDs) – she had recurrent genital herpes (Herpes Simplex Virus I and II and Herpes Gladiatorum). These STDs are such that even condoms are not effective in containing their spreading as they spread not just through sexual contact but through skin to skin contact at multiple sites where the infection happens and blisters erupt. Also the specialist Dr. McIlroy states that Aarthi Rao is highly infectious and contagious, whether or not she is having an outbreak, and even if her infection is asymptomatic.
The expert also analysed the medical reports of Paramahamsa Nithyananda which show that he has no disease.
The medical opinions clearly prove the falsity of the allegations of rape made by the false rape victim who claims she was raped over 40 times over 5 years while she herself has been suffering from incurable, highly contagious STDs (Sexually Transmitted Diseases) since at least 2004, while Paramahamsa Nithyananda has no STD.

Paramahamsa Nithyananda was subjected to excruciating agony to fulfill the ridiculous demands of the Karnataka CID to undergo potency tests. The testing procedure and the medications administered left him unable to even walk out of the hospital. Much to the shock and dismay of all his sanyasis and devotees He had to be wheeled out in a wheel chair causing undue duress and pain to all of them. The magnanimity of the web of fear and uncertainity created by the fabricated lies of the media propaganda, left many of his devotees in deep anguish – not understanding what was really happening as it seemed to be happening in a horror movie.
In spite of undergoing this ordeal he has publicly declared His trust on the Indian Judiciary to disprove the alleged victim’s rape charges against Him.
In a public satsang (public spiritual talk), His Divine Holiness Paramahamsa Nithyananda told devotees that he has complete faith in the judicial system, referring to His potency tests that have been submitted to the State police by doctors of the Victoria Hospital as per the Hon’ble Supreme Court ruling. “India is not a banana republic,” He said.
He further said that if someone tries to kill him, there would be a huge sympathy wave in his favour. “For every drop of blood that is shed from my body, a new Nithyananda will stand up. The false rape victim in the case of His Divine Holiness Paramahamsa Nithyananda, Mrs. Arathi Rao, had sworn under oath to the Hon’ble High Court of Karnataka in her (dismissed) petition to implead herself in the case seeking quashing of the false case against Paramahamsa Nithyananda:
“The accused persons had published some fabricated medical documents in order to allege that the applicant (Mrs.Arathi Rao) suffered from sexually transmitted diseases and called her a fake rape victim.”
Mrs. Arathi Rao had filed the same false rape complaint in USA with her hometown Michigan police alleging rape on her by Paramahamsa Nithyananda over 40 times over 5 years, which the US police across multiple states (Michigan, California) as well as FBI closed the complaint as there was no substance in it.
The USA hospital doctors who treated Ms. Arathi Rao for her multiple STDs including Herpes simplex, Genital Herpes, Herpes Gladiatorum, have sworn under oath that the medical reports of Mrs. Arathi Rao are completely true and that they have given the medial findings documented in her medical records which was submitted by the Hospital on the direction of the USA Court to the Indian Court and Karnataka CID as well as the lawyer of Paramahamsa Nithyananda for his defense in the false rape case against him by Mrs. Arathi Rao.
Since 2014, the legal team of His Divine Holiness Paramahamsa Nithyananda began collecting evidence which unquestioningly proves His innocence. These included medical reports of Paramahamsa Nithyananda and the false rape victim, Arathi Rao. Finally, the high court of Karnataka accepted to open this evidence in court and use it to help the cases filed against Paramahamsa Nithyananda. This development was sure to expose the conspirators against His Divine Holiness.

In a landmark judgment for His Holiness Paramahamsa Nithyananda, the Hon’ble High Court of Karnataka ordered for the production of all the documents and evidences that had been collected by the police but not yet produced to the Court. These include the medical reports of the alleged rape victim Ms. Arathi Rao from 2004 to 2009 showing she has had 4 highly contagious and incurable STDs some of which are transmitted by mere touch. The evidence also includes her own email admission in mid-2009 (six months after her last alleged instance of rape) that she never had any kind of sexual relationship with Paramahamsa Nithyananda. In addition to this, multiple discrepancies in the dates and locations of the alleged rape incidents (in fact, one instance of claim of alleged rape was in Salem, Tamil Nadu, while her medical records show that she was meeting with her doctor in USA on that very same day). Finally it also included, Paramahamsa NIthyananda’s medical reports showing he has never had any STDs and has a yogic body and not capable of a sexual act. Among everything else, there was also a number of critical witness statements, amongst all the other evidences as documented in the case diary. The Hon’ble High Court has clearly ordered for all the records of the case for the Trial Court to look into. This is a critical breakthrough in the case in favour of Paramahamsa Nithyananda as multiple evidences in his favour have been ordered to be produced by the Hon’ble High Court of Karnataka which can be used for dismissal of the case against him.
