A woman with multiple non treatable infectious STDs accuses a man of raping her more than 40 times over 5 years and that person doesn’t contract any of those STDs. And further accuses him of forcing her to sign an imaginary ‘Sex Contract’.

This in a nutshell is the story of the rape case of Ms Arathi Rao a US citizen against Swami Nithyananda.
This is also a case study how media conspired to put an innocent in Jail and has to run pillar to get a day in court.
In this article I would focus on a specific article by thenewminute (co-founded by Chitra Subramaniam ) whose editor-in-chief Dhanya Rajendran’s (ex reporter with TimesNow and a history of presstituting ) justification for the article is truly a benchmark for pressitudes.
Dhanya’s defence : She trusts the victim. And documentary evidence means nothing to her. But when did media ever let truth interfere with a good story.
The thenewsminute article primarily talks about an imaginary “Sex Contract” between the victim and the accused.
Let’s dig into
The ‘Sex Contract’
The article in thenewsminute fails to provide a copy of the contract, I wonder why ? They don’t even mention who the 2 signatories on the contract are. All they do is quote from an imaginary contract.
The thenewsminute article further states
The contract further functioned as a gag order, threatening devotees with consequences if they were to reveal to outsiders.
This puzzles me as any contract that is signed in India is subservient to constitution. How would such a contract have any legal standing ?
Or does the imaginary contract have some other purpose ? I would guess misrepresentation in public. Why has no media house has ever published the actual contract ?
“No, we did not,” says a survivor, who signed one such document, to TNM.
This statement on the article indicates there were multiple “victims”. In reality there is one one person Ms Aarthi Rao who claims to be the victim.
Let’s look into the section
Raped for enlightenment ?
This section quotes a lot of stuff from the complaint by to police. One can practically add anything in the complaint. But the crux of it is again signing of the “sex contract”
‘Thus he attacked her mind and took control of it and made her go into a state of total surrender’ says the chargesheet. It further claims that Amala lost her ability to think clearly and was overcome by blind faith. Following this she was raped multiple times in various hotels and the Bidadi Ashram.
Amala is the alias for Aarthi Rao in the complaint. Thenewsminute has no problem using the name multiple times without mentioning that is a pseudonym apart from an asterix once.
I want readers to remember that Aarthi Rao accuses that the incidents of rape occurred multiple times. I’ll come back to this later.

The case against Nithyananda is currently pending for trial at the Ramanagara sessions court, the trial has not even started. The accused has filed a discharge petition, where they have claimed that there is no prima facie case. Nityananda’s counsel has requested that he be discharged without the hardship of trial. The Court’s order on the petition is still awaited.
Who is delaying the case ? Is it Swami Nithyananda’s side or the other side. Who is preventing the case from starting in the trial court once the chargesheet has been filed.
The prosecution knows they have no case (which I will explain later in this article) and are dragging their feet.
The judge can either order a discharge in which case the self-proclaimed godman will be acquitted without trial or he can order a trial saying there is enough material.
But judge has to look at the evidence before issuing an order. This is a standard technique any lawyer would use especially if he is representing the innocent. This is a way to get judge’s attention to the case. Would a guilty person want Judge’s attention esp from higher court where they are much more tougher.
What choice does the defendant have when they know they are innocent and is being denied the opportunity to prove their innocence in lower courts. Instead of having this case live in perpetuity. They have to approach the higher court to expedite it. Any decent lawyer will ask for discharge of case if prosecution doesn’t want to proceed. Asking for discharge is a way to “force” the court to look into the case. Its standard operation procedure but it gives a good clue who wants to go to court and present their case.
The losing side delays and does want to go to court. But the winning side wants to go to court. When was the last time we saw the “criminal” side want to have a quick trial ? In a rape case who delays the perpetrator or victim ? The answer is: the guilty perpetrator
Even a dead body can be declared potent is the popular saying about certain potency tests in the medical community. Hence are not reliable.

Clearly Aarthi Rao wants to delay the case not Sri Nithyananda Swami.
By now I hope I have presented enough data countering every assertion in the article by thenewsminute. And would encourage the reader to judge the facts and data for themselves.

What does the FBI medical expert have to say about the nature of the disease. Aarthi Rao’s infection can spread via skin-to-skin physical contact.
And the medial expert concludes the incidences of rape / sexual abuse are false
The prosecution agencies in India know about the medical history and hence are reluctant to move forward with the case.

One might wonder if the alleged “victim” had all these STDs then why did the CID file a chargesheet. This where the whole thing gets interesting to say the least.
Very Very brief history of true events from the beginning:
Police originally filed a case based on the fake video (widely circulated by media esp by SUN TV who was blackmailing for money) of Nithyananda Swami and actress Ranjitha (now a sanyasi in the Nithyananda monastic order).
I would like to remind readers about common knowledge on media houses blackmailing prominent people including politicians, businessmen, Gurus etc for money or other favours else publish fake stories.
The videos were proved to be fake by experts.
The news channels themselves were reprimanded by Broadcasting Content Complaints Council (BCCC)

Police got fooled by media because they trusted the media and believed their reporting that there really was an incident so arrested Nithyananda Swami and then begin to look for victims. (A hard lesson for Police or government agency to not trust media)
Yes! Police arrested and jailed Sri Nithyananda Swami without a victim. After the arrest they began to search for victim.
When Aarthi Rao showed up (her other co-conspirators have since then been charged or jailed for blackmail and child abuse in India and USA) it probably was a big relief for them.
And subsequently court ruled Nithyananda Swami arrest was illegal.
the District Magistrate had no authority to remand the petitioner to judicial custody, as such, the remand of the petitioner to judicial custody was without authority of law.

When documents about Ms Aarthi Rao’s STDs were obtained from US hospitals via court order, the case against Sri Nithyananda Swami collapsed. This is a major source of embarrassment for investigation agencies as they got duped by media big time. It’s easy for one to admit a mistake but not stupidity.
They would rather let it slip away quietly and not proceed with prosecution.
From the point of view of Media and their pay masters they won as they have managed to convince average person Sri Nithyananda Swami is dangerous. Media stayed true to their motive, Lie big and retract small.
In such a scenario what can a being like Sri Nithyananda Swami when media and government are out to get him and public who will not use google think he is guilty?
Only option left is to get his day in court to present before the Judge the evidence.
What legal strategy does one adopt to get the court to start a trial with an “extremely reluctant prosecution” ?
Answer is: Approach High Court and demand attention.
Would a guilty person demand attention from court in a stalled case ? Answer: NO
After approaching the HighCourt , the court ordered to start the trial. But the the other side went to the Supreme Court. But the supreme court upheld the High Court’s view.
This is even more bizzare, if HighCourt said start the trial, why would the other side oppose it ?
Why has thenewsminute left this information out ?
There are couple of more conspirators along with Aarthi Rao – Lenin and Vinay Bharadwaj (a child molester and convicted felon). Swamiji took in Vinay’s victims and transformed them.
How many women’s lives will the likes of Dhanya go out to destroy ?
As usual why would Dhanya let truth interfere with her page views ? The bad habits she has picked up from TimesNow are perhaps hard to break.

Reader also might wonder why did Sri Nithyananda Swami target so brutally. I have not spoken about attack on his Sanyasi’s, rape attemps Which media house has covered them truthfully. What makes Swamiji so special at such a young age ? In 2008 he was only 30!
