Illegal arrest and Conspiracy to Kill His Divine Holiness Paramahamsa Nithyananda

In March 2010, His Divine Holiness Paramahamsa Nithyananda was subjected to a media trial due to the release of the infamous video depicting him in morphed images. The media launched an aggressive and offensive campaign, targeting the public image of His Divine Holiness. The atmosphere created was reeking with distrust and betrayal. A hype of hatred was created which led to the illegal arrest and imprisonment of Paramahamsa Nithyananda.
In 2012, the same media frenzy lead to the second illegal arrest of His Divine Holiness Paramahamsa Nithyananda. The relentless and planned hate campaign and persecution was executed with single pointed focus – to decimate Paramahamsa Nithyananda and his organization. The hype created to malign his image was so vindictive that even basic inquiry into validity of the false accusations against him were not carried through diligently by the police. A man-hunt scenario was created as though he was a fugitive on the run.
While being held in custody, illegally, there was also a sinister attempt to assassinate him. When in custody, Paramahamsa Nithyananda’s food was laced with poison. Fortunately for him, the jailer who had been healed of his chronic backache problem by Paramahamsa Nithyananda carried a soft corner towards him. He became aware of the conspiracy to poison his food, and so he sneaked in a slip with the food, which read ‘Please do not eat this food, it has poison.’ This fact got confirmed as a rat happened to eat a bit of this food, and died immediately – thereby confirming that food was laced with poison.

Court Adjourns That The FIR Holds No Authority
The arrest was a blatant contempt of the law, that was later condoned by the Court through these very words verbatim:
11) Perusal of the FIR in the case on hand indicates that the respondent-police had registered the case for the offence under Section 107 r/w. 151 of Cr.P.C.. This court is not able to understand as to how the police officer could register the case for the offences under Sections 107 and 151 of Cr.P.C. when those sections does not deal with any offence and they deal only with the preventive measures.
Therefore, the registration of the FIR under those Sections is without any authority, as those sections does not deal with any offences. Perusal of the certified copy of the proceedings before the District Magistrate would indicate the further illegality in the proceedings. Based on the FIR submitted by the respondent-police, the District-Magistrate initiated the proceedings under Section 107 of Cr.P.C. On…..(Actual court paper with the condonation is as below)

(Video Transcript in English) Nithyananda who was arrested for attacking journalists is scheduled to be presented by the police before Ramanagara court. Nithyananda Swami surrendered in Ramanagara court yesterday. Since police said they cannot give security to him in the Ramanagara sub-jail, he is spending his time in Chennapattana jail since yesterday. Came to know that police drilled him enough and got some valuable information from him. He will be brought under Ramanagara court in few hours. There are few hundreds of Nava Karnataka volunnteers and few people to see Nithyananda gathered. He is the main accused in the case of attacking the journalists but he applied for pre-bail, based on the decision, he may be sent back to Chennapatnam or the local police may keep him for 3 more days, there are high chances of this. |
His Divine Holiness Paramahamsa Nithyananda Denied Rights to do Puja during Arrest
Paramahamsa Nithyananda was subjected to tremendous Human Rights Violations during his imprisonment. He was denied his spiritual rights to do Atmartha Puja, a 2000-year old tradition of worshiping an ancient Shiva linga of Madurai Aadheenam. This linga is worshiped by the Guru Maha Sannidhanams (Pontiffs) of the Madurai Aadheenam, and have been passed on through the centuries from one pontiff to the next. The tradition of worshiping this linga everyday is an unbroken tradition, which the CID forcibly halted during the illegal imprisonment of Paramahamsa Nithyananda.
Confiscating his rudraksha mala (necklace of holy beads) which he used for chanting purposes, throwing bucket of cold water in his cell floor so the body is cold and wet, not permitting him to have his food brought for him from his ashram, taking away his shivalinga and being responsible for breaking the 2000 year old tradition of worshiping this holy relic – all out of spite with no other particular agenda. Misuse of power of position and behaving in inhumane way towards humans are violations of basic human rights. Such atrocities were borne by one who had not even been charged of any crime.
It still continues eight years after the event awaiting justice in the court of law.

The police took away Swamiji’s rudrakasha mala which he has had ever since Parivrajaka days. Police refused his rudrakasha to wear and Shivalinga to worship. Swamiji had a fight in court to get the Rudraksh back. The shivalinga had been worshipped by various being for an unbroken period of 2000 years. Finally because of illegal arrest and police atrocities, the 2000 year old tradition got broken.
While Paramahamsa Nithyananda initiates thousands into doing shiva puja, He himself was denied the right to do puja while being illegally arrested.

High court rules: “the District Magistrate had no authority to remand Paramahamsa Nithyananda to judicial custody”

The high court quashes Ramanagara magistrate ruling of detaining His Divine Holiness Paramahamsa Nithyananda in police custody. The court states: “the District Magistrate had no authority to remand Sri Nithyananda Swami to judicial custody. As such, the remand of Paramahamsa Nithyananda to judicial custody was without authority of law.” This was actually a diabolical plan to keep His Divine Holiness in custody in the name of protecting law and order and kill him by administering poison.
The High Court of Karnataka on 25 February 2013, quashed the First Information Report (FIR) filed and the action initiated by the District Commissioner, Ramanagara against Paramahamsa Nithyananda in the case filed on 14 June 2012 in Cr. No. 308/2012 of Bidadi Police Station, u/s 107 r/w 151 of Cr.PC.
The Sub-Inspector of Police (SI), Bidadi Police Station, had registered the case and arrested Paramahamsa Nithyananda. The District Magistrate, Ramanagara, in turn, remanded him to judicial custody for 7 days and directed Him to be kept in Central Prison, Mysore. Thereafter, the District Magistrate passed an order directing Paramahamsa Nithyananda to execute a bond for Rs. 1 lakh, to be in force for a period of 1 year.
The Hon’ble High Court of Karnataka, made some grave observations in the gross mishandling of and illegalities in the actions of all the officials involved in these proceedings.
The High Court observed that Sections 107 and 151 of Cr.PC. do not deal with any offence, for which a crime could be registered as they only deal with preventive measures. Therefore the registration of the FIR under those Sections is without any authority.
The High Court categorically stated in its order, “Reading of Sections 107, 111, 116 and 151 of Cr.PC. does not indicate any power on the part of the executive magistrate to remand the petitioner to judicial custody”.
Section 151 (2) of Cr.PC. clearly directs that ‘No person arrested under Section 151(1) shall be detained in custody for a period exceeding 24 hours from the time of arrest.’
The High Court further pointed out that, ‘The only circumstance in which the District Magistrate or Executive Magistrate could detain a person in custody, is, where the Executive Magistrate passes an order in writing directing the person to execute an interim bond pending inquiry in terms of Section 116 (3) of Cr.PC., and failure or default on the part of such person to execute such interim bond.”
The High Court made a serious observation, “There is absolutely no material on record to indicate that the District Magistrate in exercise of power under Section 116(3) of Cr.PC. directed Paramahamsa Nithyananda to execute an interim bond pending inquiry”. Therefore, there was no compulsion on the part of Paramahamsa Nithyananda to execute an interim bond.
Therefore, the District Magistrate had no authority to remand Paramahamsa Nithyananda to judicial custody. As such, the remand of Paramahamsa Nithyananda to judicial custody was without authority of law. This was actually a diabolical plan to keep His Divine Holiness in custody in the name of protecting law and order and kill him by administering poison.
High Court observed that even when the person needs to be called upon to show cause under Secton 107 of Cr.PC., it is mandatory as per Section 111 of Cr.PC. to pass a preliminary order in writing, detailing the information received and the bond execution details.
In the case of Paramahamsa Nithyananda, there was no preliminary order as required under Section 111 of Cr.PC.
The High Court, therefore, ordered that the entire proceedings before the District Magistrate, Ramanagara, and various orders passed therein, are contrary to law and without any jurisdiction. The High Court thereby quashed the FIR and the proceedings thereon taken before the District Magistrate culminating in the orders directing the execution of the bond.

Karnataka HC quashes Suvarna TV false case against His Divine Holiness Paramahamsa Nithyananda

Suvarna 24×7 News Channel editor Ajith Hanumakkanavar plans a life-attack on His Divine Holiness Paramahamsa Nithyananda and files a false case against Him as well. Hon’ble Karnataka High Court quashes the false case.
On 15 March 2013, the Hon’ble High Court of Karnataka quashed the false case filed by Suvarna 24×7 news reporter, Ajit Hanumakkanavar, in June 2012 against Paramahamsa Nithyananda.
What Happened in June 2012?
His Divine Holiness Paramahamsa Nithyananda was holding a press meet at His Bengaluru Aadheenam. At that time, a Suvarna New reporter, Ajit Hanumakkanavar who was sitting in the first row suddenly jumped the barricade near the dais and attempted to hand an unidentified paper package to His Divine Holiness, which he claimed to be a court summon! Completely breaching all social, ethical and legal standards and security, Ajit Hanumakkanavar behaved like a local goon although wearing the badge of Suvarna 24×7 News channel!
Sensing a possible security hazard, ashram personnel tried to remove him and the package from the hall for which Ajit did not co-operate but instead started becoming more aggressive and abusive.
The Planned life-Attack
It was later discovered that a group of people with a malicious agenda of life-attack on Paramahamsa Nithyananda had trespassed into the campus by showing their media cards and carried out this deliberate illegal attempt, spear-headed by Ajit. The same group also abused the female Sanyasis and devotees of Paramahamsa Nithyananda by calling them prostitutes and some even tried to molest the female Sanyasis (Hindu monks) in the physical assault they had launched by then. Ajit’s henchmen jumped over the Aadheenam gates and entered and inflicted violent physical blows on several members of the Aadheenam with sharp objects.
In what turned out to be a life-attack, Sri Nithya Atmaprabhananda sustained a serious head injury with huge blood-loss and had to be rushed for an immediate surgery for the same. The entire attack of Ajit and his henchmen has been thoroughly video-recorded capturing their vandalism of the Aadheenam properties and life-attack on the residents.
It was later learnt that it was a clearly planned life-attack on His Divine Holiness Paramahamsa Nithyananda, thus expelling Him and His organisation out of Karnataka. Click to see Paramahamsa Nithyananda’s video talk on the whole attack.

Transcript of video: Yesterday the suvarana news channel one of the editor illegally came here in the name of media person and try to abuse,create rukus ,assaulted our sanyasinis and pushed and pulled diffrenrt rishis and ashramites and not only that when we filed the complaint, fortunately whole thing was vedio recorded and the vedio record was handed over to police and then they went and brought sent their henchman and beaten our sanyaasis left and right, you can see- why dont you show, that how they jumped and came inside the ashram. See they jumped the gate and came inside the ashram with a clear motive of killing me, shouting sceraming that we will kill the Swamiji and we have the photographs here show it and they have beaten many of our sanyaasinis sanyaasis left and right, Atma prabhananda ashram manager, administrative head has been beaten so badly you focus the camera on that, you can see now people jumping in and coming inside the ashram and here you can see Atma prabha being beaten not only bleeding, he is still in hospital, he has gone through surgery with lot of stiches and ofcourse not only atma prabha many of our sanyaasis and sanyaasinis have been beaten by this hench men of suvarana news channel. You can see Yogananda been beaten and surrounded by many many of this hench men rowdies, it all happened inside our campus. Pls understand they jumped inside our campus came inside to attack me. Ofcourse the blows which I was supposed to receive has been received by sanyaasis and sanyaasinis and they stopped these rowdies outside itself and as ususal police came very late and throw them out. You can see we have whole thing vedio recorded it has been presented to the poilce we have filed FIR,second FIR has been filed, a second FIR is clearly and Nateshananda was also beaten. Anyhow still Atma prabha is still in hospital, he may have to stay in hospital for next one week, Suvarana new channel has directly taken the job of trying to drive us out of Karnataka we will continue to serve karnataka doing all our spiriyual activities and social services in a greater free spiritual way. Now the whole world can see very clearly the conspiracy Suvarana channel was airing, conspirators abusers and false allegations went on for so many days now the whole wolrd can see their vested intrerest. They went to the extreme of abusing and attcaking our sanyaasis and sanyaasinis with the hench men but no spiritual work will stop. Yes I remember very clearly when Swami Narayana started initiatiing people, started spiritual mission 600 of his grihastha devotees were beaten left and right and 7 people died overnight. Whole village 500 people attacked Swami Narayan’s disciples. 600 of them have been beaten and 7 died overnight and next day morning he has initiated all the grihasthas healed all of them, initaited all of them as Paramhamsas and sent all of them all around the world. Pls understand when Bhagwan was, swami narayana was in the body that time itself he sent the ambassadors around the world ,not just around India already when he was in body at that time itself people have crosssed the ocean went to cylone, went to Burma, China, went to Middle East for preaching and teaching. All 600 of them who have been beaten finally became the pilllars and created one of the world’s largest mission I can vey clearly compare that with this incident. When there is big spiritual wave rasing these are all inevitable more and more these kinds of attacks makes our sangha more and more strong stable and spiritually radiating and powerful. I can see vey clealry how we are emerging from every attack more and more stronger. I wanted to tell all our devotees dont think Kalabhairva is keeping quite, He is doing His Job. He is really doing his job. He is doing His job properly, where all our ashramites will present the photos and vedios on their side story completely with the evidence. All this attack happened inside our campus, they jumped the gate and came inside and attacked because they have come here to attack and kill me fortunately our sanyaasis have stopped.Actually I was having ashramites meeting at that time and our sanyaasis have rushed to stop them coming inside. Through stones and stools and furnitures our sanyaasis and sanyaasinis have manhandled them and rods. We have whole thing video recorded and photographed. Hope we will get justice.

Ajit files a false case on the Aadheenam after victimising it! Aadheenavasis illegally arrested.
Suvarna 24×7 News channel editor Ajith then goes on to file a case against Paramahamsa Nithyananda alleging that he had incited attacks by the ashramites on him (Ajit). The attacker himself files a case on the victim! The case led to the most surprising and illegal arrest of several Aadheenam residents personally identified by Ajith.

On 13 March 2013, Sri Nithyananda Swami filed a defamation suit against Suvarna 24×7 at the JMFC, Ramanagara. Suvarna Channel along with Ms.Aarathi Rao, the false rape victim who has filed a false rape case on His Divine Holiness, have been waging a relentless vengeful slander and abuse campaign against Him.
On 9th March 2013, Mr. A.C. Narendran, a devotee of Sri Nithyananda Swami, filed a complaint at the High Grounds Police Station in Cr. No. 0081/2013, against the continuous vengeful onslaught of Suvarna TV on Paramahamsa Nithyananda, the most recent one being an open, blatant show of violence on a panel discussion where the panellist wielding a chopper openly issued a threat to life to Paramahamsa Nithyananda and His followers.
