After the release of the morphed video, an advocate in Tamil Nadu filed a baseless complaint accusing His Divine Holiness Paramahamsa Nithyananda of hurting his religious sentiment with this video. The complaint was registered and a summons was issued. After six long years, the abominable case was quashed by the Hon’ble High Court, stating it was completely baseless.
11 March 2010: In the wake of the nonstop telecast of the morphed video by Sun TV and its accomplice TV channels, an advocate, Selvamani, filed a complaint at Sriperumbudur in South India, alleging that his religious sentiments were hurt seeing the morphed video and holding His Divine Holiness Paramahamsa Nithyananda responsible for the same. The irony is that the complaint should have been filed against the creators and telecasters of the morphed video but rather it was filed against the victim.
To add to this, the Municipal Judicial Magistrate, Sriperumbudur, took cognizance of the complaint and registered it in CC 55/2010 on 12 March 2010. A summons was issued to appear on 2 April 2010. Given the circumstances and threat to life of Paramahamsa Nithyananda, he could not appear on the day and a bailable warrant was issued on 19 April 2010. The bailable warrant was recalled on 20 April 2010, a day before the day of the illegal arrest of Paramahamsa Nithyananda. The whole arrest was illegal as the police lied to the Court that Paramahamsa Nithyananda was arrested and hence his anticipatory bail application was infructuous (ineffective).
This happened in spite of the law requiring that this particular Section 295 (A) – hurting religious sentiments statutorily requires that the sanction of the Central or State government be obtained – which in this case was not obtained by the complainant, evidently as it was a baseless and false complaint to start.
28 November 2016: The False Case Quashed
After over 6 years, the Hon’ble High Court Judge of Madras quashed the whole case with strong observations reprimanding the illegality of the very cognizance of the false, motivated case.
The Hon’ble High Court Judge observed, “The complaint has been preferred without application of mind to the statute, facts, and materials. The Learned Judicial Magistrate erred in taking cognizance of the case…the alleged offense is also baseless.”
